Terms & Conditions
1. 2009 members wishing to renew their membership for 2010 have an exclusive renewal period until close of business on Friday 30 October 2009. After this time renewing members cannot be guaranteed their existing seats. 2. All prices included in the membership brochure are inclusive of GST 3. Cancellations - Once a membership is processed, cancellations will not be accepted unless in extraordinary circumstances, and under no circumstances once the season has begun. Any cancellation requests deemed to be appropriate by Brumbies Rugby, will at a minimum be required to downgrade to 'Brumbies' memberships rather than cancelling completely. The decision on the appropriateness of cancellation requests is entirely that of Brumbies Rugby, and no correspondence will be entered into. 4. Dishonored Credit Card Payments - If a credit card payment is declined by your bank, you will be contacted regarding an alternate form of payment. All dishonored credit card payments will incur an immediate fee of $20 as these fees are applied by the bank. If the further payment option is not successful your order will be removed from the seating allocation queue and referred to the Brumbies Membership Manager. 5. If the further payment option is not successful your order will be removed from the seating allocation queue and referred to the Brumbies Membership Manager. 6. Concession membership - Pensioner or Seniors Card or a Full Time Student card. Please note that Health Care Cards are not accepted as a form of concession. It is a condition of these concessions that you agree to present your concession ID upon entry to the venue, if requested. 7. Transfer of Membership - Your Brumbies membership is transferable however; you must ensure that the person using your card for access to the venue is eligible to do so, eg. An adult may not use a Concession or Junior Registered Player Card. 8. Lost or Stolen Membership Cards - Can be replaced for a fee of $20. If there are insufficient games remaining in the season paper tickets will be supplied instead. To obtain a replacement card, members must call the Membership Hotline on 1300 733 899. 9. Updating Personal Details - All season members must take responsibility for updating all personal details so the Brumbies can communicate effectively with them. The Brumbies hold no responsibility for member’s failure to update their personal details. To update your personal details please go to the Online membership service or call the Membership Hotline (1300 733 899). 10. Discount on Merchandise - The 10% members discount on official Brumbies merchandise is available to members on presentation of their membership card at Brumbies HQ, the retail store located at the Brumbies Rugby Offices, Austin Street Griffith, ACT and the merchandise outlets at Canberra Stadium. This offer is not redeemable for cash and cannot be used in conjunction with any other offer. 11. CA Brumbies Movie Madness • Maximum of 2 tickets per card per day, when purchased for the same film and for the same session • Valid at all ACT Hoyts locations • Not valid on Saturday after 5pm • Not valid with any other offer • Not valid for special events • Not valid for online or mobile ticket sales 12. Terms & Conditions - Ultimate Game Day Experience Promotion Period 12-1. The promotion commences Tuesday 1 September 2009 12.00am AEST & closes Thursday 4 March 2010, 11.59pm AEST Entry Requirements 12-2. Information on how to enter & prizes form part of these Terms & Conditions. Any entry not complying with these terms and conditions is invalid. Participation in this promotion is deemed acceptance of these Terms and Conditions. 12-3. Entry is open to residents of Australia. Employees of the Promoter, the Promoter’s agencies associated with this promotion and their immediate families are ineligible to enter. 12-4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the discretion of The Promoter. Failure by The Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 12-5. To enter, purchase a 2010 CA Brumbies membership online at www.brumbies.com.au, during the Promotion Period to be automatically entered into the draw. 6. One (1) entry will be submitted per membership purchased. Multiple entries will be permitted. 12-7. The Entrant will be the purchaser of the membership. If there is a dispute as to the identity of an entrant, The Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 12-8. Entrants must retain their purchase receipt(s) for all memberships purchased as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of The Promoter, result in forfeiture of any right to a prize. Prize Draw 12-9. Entries will close Thursday 4 March 2010 11.59pm AEST. 12-10. One (1) First prize winner (“Winner”) will be drawn randomly from all valid entries received by The Promoter. Twenty (20) Runners Up prize winners (“Runners Up”) will then be drawn randomly from all remaining valid entries received by The Promoter. (Cost of First prize estimated at $30 – Cost of 1x Adult General Admission Ticket for entry. Total cost of Runners Up prizes estimated at $450) 12-11. The Prize Draw will take place at 3:00pm AEST at Brumbies Rugby Offices, Austin Street, Griffith ACT 2603, on Monday 15 March 2010. The Winner and Runners Up will be notified via telephone, email and mail, and will have their names published in that week’s edition of B-Mail. 12-12. The Winner and Runners Up’s name will also appear on www.brumbies.com.au. 12-13. If any Winner is under the age of 12 years, the prize will be awarded to the Winner's parent/guardian on their behalf. No-one under the age of 12 will be allowed in the tunnel or field areas during the match. Unclaimed Prize Draw 12-14. The Promoter may conduct an unclaimed prize draw (“Unclaimed Draw”) at the same place and time as the original draw on Tuesday 30 March 2010 to distribute any prizes unclaimed by that date subject to any written directions given under any regularity authority. 12-15. Winners from the Unclaimed Draw will have their name and postcode published in that week’s edition of B-Mail and will also appear on www.brumbies.com.au Prize 12-16. First Prize: (a) Opportunity for the Winner to watch a CA Brumbies match from the bench. (b) Opportunity for the Winner and three (3) friends to tour the CA Brumbies change room during the day of the match. 12-17. Runners Up Prizes: 20x CA Brumbies digitally autographed balls 12-18. The tour of the change room will take place before the team arrives, and exact timing will be at the sole discretion of The Promoter. 12-19. The Winner will be chaperoned by a Brumbies staff member at all times. 12-20. The Winner will be required to meet with Brumbies Rugby officials prior to the event for a full briefing. 12-21. No mobile phones or cameras are to be taken into the tunnel area or onto the field by the Winner. 12-22. The Promoter reserves the right, in it’s sole discretion, to abandon or postpone the activity. 12-23. The prize must be taken as stated and cannot be varied. No compensation will be payable if the winner is unable to redeem the prize as stated. The prize is not exchangeable or redeemable for cash or other goods and services. The prize cannot be transferred to another person. 12-24. The Prize must be redeemed before Monday 10 May 2010. 12-25. The prize does not include travel expenses, transportation, passport and visa fees, travel insurance, meals, merchandise of any description, any extra accommodation or any other costs of a personal, incidental or ancillary nature. General 12-26. The personal information supplied by entrants when entering this Promotion will be used by The Promoter in accordance with its Privacy Policy. Please refer to the Privacy Policy by visiting www.brumbies.com.au for more information. Entry into this Promotion is an agreement to be bound by that policy. 12-27. The Promoter’s decision is final and no correspondence will be entered into. 12-28. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite The Promoter’s reasonable endeavours to procure within Australia, The Promoter reserves the right to substitute a different prize item of equal or greater value. 12-29. By entering the competition, Winners agree to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation and agrees that The Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s. 12-30. If for any reason this promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of The Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion, The Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process. 12-31. Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under The Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any variation in prize value to that stated in these Terms and Conditions; (d) if the 2010 Investec Super 14 Season is cancelled for any reason beyond the reasonable control of The Promoter; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize. 12-32. Membership Plus Card - CA Brumbies Members will receive a 15% discount off the purchase price of a ticket when presenting their Membership Plus card with their 2010 CA Brumbies Membership Card. Membership Plus cards can be used when purchasing tickets to the following games: Week 4 CA Brumbies v Lions – Friday 5 March & Week 7 CA Brumbies v Chiefs – Friday 26 March 14. Your Privacy is important to the Brumbies and a copy of our Privacy Policy is available on our website at www.brumbies.com.au or you can call the Membership Hotline on 1300 733 899 and request that a copy of the policy be mailed to you. 18. Payment Plan: • By selecting the payment plan option you have entered into an agreement to ensure sufficient funds are available for each installment. • Brumbies Rugby will not issue reminders or invoices for payment plan installments and reserve the right to refuse or cancel a payment plan agreement. • Pay for your membership by four equal payments over four (4) months • A $4 per payment processing fee will apply to the three (3) additional payments ($12 in total) • Membership is not valid until full payment is received 19. Postage & Handling: Overseas members - Members living outside of Australia are required to select "Postage & Handling: Overseas Members" as an optional add-on when renewing or purchasing membership online. This is incur the $10 postage and handling fee for overseas members. If tyhe members does not select this option, Brumbies Rugby reserve the right to request additional payment before porocessing the membership.
